Dezember 2022 hat das Bundesarbeitsgericht festgestellt, dass der Anspruch auf gesetzlichen Mindesturlaub aus einem Arbeitsjahr, in dem ein Arbeitnehmer aufgrund von gesundheitlichen Gr\u00fcnden daran gehindert war, seinen Urlaub zu nehmen, normalerweise nicht automatisch nach Ablauf eines \u00dcbertragungszeitraums von 15 Monaten verf\u00e4llt. Diese Regelung gilt jedoch nur unter der Bedingung, dass der Arbeitgeber dem Arbeitnehmer die M\u00f6glichkeit gegeben hat, den Urlaub rechtzeitig zu nehmen. Diese Auslegung beruht auf den Vorschriften des \u00a7 7 Abs. 1 und Abs. 3 BUrlG.<\/div>\n<div>\u00a0<\/div>\n<div>Der Kl\u00e4ger, der als schwerbehinderter Mensch anerkannt ist, arbeitet als Frachtfahrer f\u00fcr die beklagte Flughafengesellschaft im Bereich Bodenverkehrsdienste. Aufgrund voller Erwerbsminderung aus gesundheitlichen Gr\u00fcnden konnte er von Dezember 2014 bis mindestens August 2019 nicht arbeiten und somit keinen Urlaub nehmen. Er macht geltend, dass ihm noch Resturlaub aus dem Jahr 2014 zustehe, der nicht verfallen sei, da die Beklagte ihre Pflichten zur Gew\u00e4hrung und Nutzung des Urlaubs nicht erf\u00fcllt habe.<\/div>\n<div>\u00a0<\/div>\n<div>Die Vorinstanzen wiesen die Klage ab, aber die Revision des Kl\u00e4gers hatte teilweise Erfolg hinsichtlich des Resturlaubs aus dem Jahr 2014. Im Gegensatz zur Ansicht der Beklagten verfiel der nicht genommene Urlaub des Kl\u00e4gers im Jahr 2014 nicht nur aufgrund seiner gesundheitlichen Einschr\u00e4nkungen.<\/div>\n<div>Normalerweise verfallen Urlaubsanspr\u00fcche am Ende des Kalenderjahres oder nach einem zul\u00e4ssigen \u00dcbertragungszeitraum, wenn der Arbeitgeber den Arbeitnehmer zuvor zur Urlaubsnahme aufgefordert hat und der Arbeitnehmer den Urlaub dennoch freiwillig nicht genommen hat. Es gibt jedoch Ausnahmen, insbesondere wenn der Arbeitnehmer aus gesundheitlichen Gr\u00fcnden nicht in der Lage war, Urlaub zu nehmen.<\/div>\n<div>Fr\u00fcher erloschen gesetzliche Urlaubsanspr\u00fcche in solchen F\u00e4llen automatisch am 31. M\u00e4rz des zweiten Folgejahres (\u201e15-Monatsfrist\u201c). Diese Regelung wurde jedoch gem\u00e4\u00df der Entscheidung des Europ\u00e4ischen Gerichtshofs vom 22. September 2022 (- C-518\/20 und C-727\/20 \u2013 [Fraport]) weiterentwickelt.<\/div>\n<div>Demnach erlischt der Urlaubsanspruch weiterhin nach Ablauf der 15-Monatsfrist, wenn der Arbeitnehmer seit Beginn des Urlaubsjahres bis zum 31. M\u00e4rz des zweiten auf das Urlaubsjahr folgenden Kalenderjahres aufgrund gesundheitlicher Gr\u00fcnde daran gehindert war, seinen Urlaub zu nehmen. In einem solchen Fall ist es irrelevant, ob der Arbeitgeber seinen Verpflichtungen nachgekommen ist, da diese nicht zur Urlaubsnutzung beitragen konnten.<\/div>\n<div>Jedoch liegt die Situation anders, wenn der Arbeitnehmer, wie im vorliegenden Fall, tats\u00e4chlich im Urlaubsjahr gearbeitet hat, bevor er aus gesundheitlichen Gr\u00fcnden arbeitsunf\u00e4hig wurde. In solchen F\u00e4llen muss der Arbeitgeber dem Arbeitnehmer in der Regel die M\u00f6glichkeit gegeben haben, seinen Urlaub rechtzeitig zu nehmen, bevor die Arbeitsunf\u00e4higkeit eintritt.<\/div>\n<div>\u00a0<\/div>\n<div>Der Resturlaubsanspruch f\u00fcr das Jahr 2014, der 24 Arbeitstage umfasste, konnte daher nicht allein aufgrund der Gesundheitsprobleme des Kl\u00e4gers am 31. M\u00e4rz 2016 erl\u00f6schen. Der Resturlaub blieb erhalten, da die Beklagte bis zum 1. Dezember 2014 ihren Pflichten nicht nachgekommen war, obwohl sie dazu in der Lage gewesen w\u00e4re.<\/div>\n<div>\u00a0<\/div>\n<div>Das Urteil des Bundesarbeitsgerichts vom 20. Dezember 2022 \u2013 Aktenzeichen: 9 AZR 245\/19 \u2013 betrifft die Revision des Hessischen Landesarbeitsgerichts, Urteil vom 7.
