Um dieses Risiko zu minimieren, kann der Arbeitgeber dem Arbeitnehmer w\u00e4hrend des K\u00fcndigungsschutzverfahrens eine sogenannte Prozessbesch\u00e4ftigung anbieten, durch das er seinen Annahmeverzug beenden kann. Nimmt der Arbeitnehmer dieses Angebot jedoch nicht an und verweigert die Arbeitsleistung, steht ihm normalerweise keine Verg\u00fctung f\u00fcr diesen Zeitraum zu.<\/p>\n<p>Bei einer fristlosen K\u00fcndigung ist die Rechtslage anders: Eine solche K\u00fcndigung (gem\u00e4\u00df \u00a7 626 BGB) ist nur wirksam, wenn ein schwerwiegender Grund vorliegt, der eine Fortsetzung des Arbeitsverh\u00e4ltnisses bis zum regul\u00e4ren K\u00fcndigungstermin unzumutbar macht. Ein Angebot des Arbeitgebers zur Prozessbesch\u00e4ftigung und gleichzeitige Behauptungen, dass das Arbeitsverh\u00e4ltnis nicht fortsetzbar sei, sind daher widerspr\u00fcchlich (BAG, Urteil vom 29.3.2023 \u2013 5 AZR 255\/22). Dieses widerspr\u00fcchliche Verhalten f\u00fchrt zu einer \"tats\u00e4chlichen Vermutung\", dass das Angebot der Prozessbesch\u00e4ftigung nicht ernst gemeint ist.<\/p>\n<p>Wenn ein Arbeitnehmer nach einer fristlosen K\u00fcndigung ablehnt, w\u00e4hrend des K\u00fcndigungsschutzverfahrens weiterhin f\u00fcr seinen Arbeitgeber zu arbeiten, indiziert dies allein nicht, dass er keine Arbeitsleistung erbringen will im Sinne des \u00a7 297 BGB. In diesem Fall wurde dem Kl\u00e4ger aufgrund der gegen ihn erhobenen Vorw\u00fcrfe im Rahmen der K\u00fcndigung eine Prozessbesch\u00e4ftigung bei seinem Arbeitgeber unzumutbar gemacht. Die Ablehnung dieses Angebots f\u00fchrt nicht dazu, dass dem Arbeitnehmer nach \u00a7 11 Nr. 2 KSchG b\u00f6swillig unterlassener Verdienst angerechnet wird.<\/p>\n<p>Das Bundesarbeitsgericht entschied daher, dass der Arbeitgeber im Annahmeverzug war und dem Kl\u00e4ger sein Entgelt zahlen
