Erstens war die Arbeitssicherheit ein entscheidender Faktor: Der Einsatz von Rot als Signalfarbe wurde als notwendig betrachtet, da der Mitarbeiter in Produktionsbereichen t\u00e4tig war, in denen Gabelstapler verkehrten. Die rote Arbeitskleidung erh\u00f6hte somit erheblich die Sichtbarkeit der Besch\u00e4ftigten und minimierte das Unfallrisiko.<\/span><\/p>\n<\/li>\n<li aria-level=\"1\">\n<p><span>Zweitens hob das Landesarbeitsgericht die Bedeutung der \u201eCorporate Identity\u201c hervor, die durch einheitliche Arbeitskleidung in den Werkshallen gest\u00e4rkt wird.<\/span><\/p>\n<\/li>\n<li aria-level=\"1\">\n<p><span>Der gek\u00fcndigte Mitarbeiter konnte hingegen keine stichhaltigen Gr\u00fcnde f\u00fcr seine Weigerung vorbringen, die rote Arbeitshose zu tragen, die er zuvor jahrelang ohne Beschwerden getragen hatte. Seine \u00e4sthetischen Bedenken bez\u00fcglich der Hosenfarbe fanden bei den Richtern des LAG keine ausreichende Grundlage.<\/span><\/p>\n<\/li>\n<li aria-level=\"1\">\n<p><span>Nach wiederholten Abmahnungen und anhaltender Weigerung, den Anweisungen zu folgen, sah das Gericht das Interesse des Betriebs an einer Beendigung des Arbeitsverh\u00e4ltnisses als vorrangig an. Eine Revision wurde nicht zugelassen.<\/span><\/p>\n<\/li>\n<\/ul>\n<p><span>(LAG D\u00fcsseldorf, Urteil vom 21.05.2024)<\/span><\/p>\n<\/div>","detail_call_to_action_enabled.Value":"false","detail_slider_enabled.Value":"false","detail_heading.Content":"In K\u00fcrze: Das Weisungsrecht des Arbeitgebers","detail_text.Content":"<div>\n<ul>\n<li aria-level=\"1\">\n<p><span>Das Weisungsrecht des Arbeitgebers leitet sich aus \u00a7 106 der Gewerbeordnung (GewO) und \u00a7 315 des B\u00fcrgerlichen Gesetzbuchs (BGB) ab.<\/span><\/p>\n<\/li>\n<li aria-level=\"1\">\n<p><span>Es berechtigt Arbeitgeber dazu, bestimmte Aspekte der Arbeitsausf\u00fchrung festzulegen.<\/span><\/p>\n<\/li>\n<li aria-level=\"1\">\n<p><span>Hierzu geh\u00f6ren der Ort, die Zeit, der Inhalt der Arbeit sowie das Verhalten am Arbeitsplatz, einschlie\u00dflich der Arbeitskleidung.<\/span><\/p>\n<\/li>\n<li aria-level=\"1\">\n<p><span>Bei der Aus\u00fcbung des Weisungsrechts m\u00fcssen jedoch die Interessen beider Parteien in Einklang gebracht werden.<\/span><\/p>\n<\/li>\n<ul>\n<li aria-level=\"2\">\n<p><span>Die Begrenzungen dieses Rechts werden insbesondere durch die Grundrechte der Arbeitnehmerinnen und Arbeitnehmer bestimmt.<\/span><\/p>\n<\/li>\n<li aria-level=\"2\">\n<p><span>Arbeitnehmer sind verpflichtet, ausschlie\u00dflich rechtm\u00e4\u00dfige Anweisungen zu befolgen.<\/span><\/p>\n<\/li>\n<\/ul>\n<li aria-level=\"1\">\n<p><span>Diese Regelungen gew\u00e4hrleisten, dass die Rechte der Arbeitnehmer gesch\u00fctzt bleiben, w\u00e4hrend Arbeitgeber ihre organisatorischen Anforderungen umsetzen k\u00f6nnen.<\/span><\/p>\n<\/li>\n<\/ul>\n<\/div>","detail_cta_lead_in.Content":"","detail_cta.Attribute":"Kontakt","detail_cta.Value":"\/kontakt","detail_heading_opt1.Content":"Der Sachverhalt: Soll es eine rote oder schwarze Hose sein? Februar 2024 fristgerecht entlassen, da er wiederholt gegen die betriebliche Kleiderordnung verstie\u00df.<\/span><\/p>\n<\/li>\n<li aria-level=\"1\">\n<p><span>Seit seiner Einstellung im Jahr 2014 arbeitete der Betroffene im Produktionsbereich, wo laut Unternehmensvorgaben rote Arbeitsschutzhosen, die vom Unternehmen gestellt werden, verpflichtend sind.<\/span><\/p>\n<\/li>\n<li aria-level=\"1\">\n<p><span>Trotz zweier Abmahnungen im November 2023 weigerte sich der Mitarbeiter weiterhin, die vorgeschriebene rote Hose zu tragen, und entschied sich stattdessen f\u00fcr eine schwarze Hose.<\/span><\/p>\n<\/li>\n<li aria-level=\"1\">\n<p><span>Nach seiner K\u00fcndigung reichte der Mann eine K\u00fcndigungsschutzklage ein, die jedoch erfolglos blieb. Sowohl das Arbeitsgericht Solingen (Urteil vom 15. M\u00e4rz 2024 \u2013 1 Ca 1749\/23) als auch die 3. Kammer des Landesarbeitsgerichts D\u00fcsseldorf (Urteil vom 21. Mai 2024 \u2013 3 SLa 224\/24) best\u00e4tigten die Rechtm\u00e4\u00dfigkeit der K\u00fcndigung.<\/span><\/p>\n<\/li>\n<li aria-level=\"1\">\n<p><span>Das Gericht entschied, dass der Arbeitgeber aufgrund seines Weisungsrechts berechtigt war, Rot als Farbe f\u00fcr die Arbeitshosen vorzuschreiben.
